Please read these terms and conditions carefully before you order from our website www.waltersemporium.co.uk, operated by garden home and leisure llp. (our, we us) These terms and conditions may be modified periodically on our site.

Placing of an order with us is consent to abide by these terms and conditions.

These terms and conditions may vary so please recheck when you order.



Delivery:

Delivery times will vary by product and product group, but we always aim to get your products to you as soon as possible. Delivery charges and areas may also vary, each product will have specific information regarding delivery costs and anticipated delivery times. Some items such as coloured greenhouses may take up to six weeks delivery. These delivery times may vary due to factors beyond our control and must be regarded as approximate, and we cannot be held liable for any failure to deliver within that time.

Whilst we try to monitor stock levels carefully, if an item is out of stock and we have accepted your order we will contact you and advise of a revised delivery time, at this point you may agree to this or request a refund.

In the event we cannot supply a product within a maximum of 8 weeks, we will ask you to decide whether to place your order on back order or cancel and receive a refund. We will contact you in any case with information regarding delivery delays where necessary.

Please ensure your personal details are correct before submitting any order to reduce potential delays.

Delivery will be considered as successfully made once the product has arrived at the address specified. No signature is required for proof of delivery, except where carriers use this for their own confirmation. Products may be left at the delivery address without the Recipient's permission except where third party suppliers require signed confirmation or the recipient has expressly requested products not be delivered in their absence.

Products will be deemed your responsibility once they have been received by you, your agent or the intended recipient. Any loss or damage to the products shall then be at your own risk.

Should delivery be refused or be unable to be made at the delivery address, and re-requested for another date, we may charge for the second delivery, since we met our delivery obligations with the initial delivery attempt.

It is the recipients responsibility to sign for the correct number of packages as shown on the carrier's delivery note. Shortages must be noted on the consignment note where possible. You should notify us of the shortages within 7 days of delivery.

Products must be returned in the same condition as they were delivered. If products were delivered flat packed they must be returned in the same way. Care must be taken to ensure the return products are packed well to avoid damage or loss of parts in transit.

If boxes look damaged on delivery you are responsible to check the contents for damage before accepting and signing the delivery note. Should a product have damage on receipt of the order you are required to sign the delivery note and mark the delivery note stating the damage. Not doing so may affect a subsequent claim.

Deliveries to the Channel Islands, Northern Ireland, Isle of Man, Isle of Wight, Orkney, Shetland, Scottish Isles will incur an extra Delivery charge and may possibly incur an extended lead time. (Please note that certain items may not be deliverable to these areas).

We reserve the right not to accept any order.


Cancellation prior to dispatch

You may cancel your order prior to dispatch and receive a full refund with the excpetion of personalised products that have already been finished.


Cancellation after dispatch but before delivery

If you decide to cancel an order after the products have been despatched and commenced their carriage to you by carrier or post, we may charge you for the carriage of those products. Personalised products will be charged in full


Cancellation after receipt of your order

You may return any delivered products you have purchased within 7 working days of delivery for any reason (including changing your mind). To do so you must notify us in writing via email or post within 7 working days of delivery, with the exception of personalised products which may not be returned unless they are faulty.

If you are returning a product for any reason, except damage or manufacturer defect, You must pay the costs of returning the products to us or our suppliers. On request, we will collect the products from you, but the cost of this will be charged to you and we may deduct this from the refund.

If a product arrives in a damaged condition you must make a note on the carrier's delivery note where possible and inform us within 7 working days of the delivery.

We will not accept returns or cancellations if the products have been tampered with in any way.

While in your possession, you must keep any products you intend to return to us in good condition. Products must be returned in the same condition as they were delivered. If products were delivered flat packed they must be returned in the same way. Care must be taken to ensure the return products are packed well to avoid damage or loss of parts in transit.


Refunds

Refunds will be processed within 30 days. Refunds are not available on finished personalised goods unless faulty.


Payment and Prices:

Prices shown are in British Pounds and include VAT where applicable. For administrative and risk of credit card fraud reasons, payment is taken at the time of order. You undertake that all details you provide to us for the purpose of purchasing products or services which may be offered by us on our website will be correct, that the credit or debit card which you use is your own. We reserve the right to obtain validation and verification of the authenticity of your credit or debit card details before providing you with any products or services.


Liability:

We promise that for any product you purchase from our web site:
We have the right to refuse to sell or sell the product to you;
The product will correspond with the advertised description E&OE ( Errors and Omissions Excepted ); and
The product will be of satisfactory quality in relation to the item description and the price paid.
We will not consider claims for consequential loss in relation to distress, inconvenience or disappointment.
In any event liability shall be limited to a sum equal to the amount paid or payable by you for the product(s) in respect of one incident or series of incidents attributable to the same cause.


Products:

We make every effort to ensure the information on our site is correct and up to date. The pictures we show on site are a reasonable representation of the product, but variations must be expected in colour shape and size. We aim to have the information on our site accurate, but it is inevitable at some time that this may incorrect, inaccurate or out of date. To the full extent of the law, subject to the terms and conditions of sale, we disclaim all warranties and representations as to the accuracy of information contained in our website.

Very occasionally products featured on our web site may be known by different model numbers or branding names but are in fact the same product as stipulated by the manufacturer, these items may vary cosmetically, sometimes they are identical, we reserve the right to supply these as the products listed on our web site. These items will not be classed as substitute products. If you are in any doubt please speak to us before placing your order.

We take no responsibility for any website or contents of, linked to our own.


Warranties:

Warranties provided by manufacturers are clearly shown where applicable, and are not given by us but the manufacturer. Due to the nature and varied use of garden furniture we must limit the warranty to 28 days.

These Terms and Conditions and your use of our website are governed by English law and you submit to the non-exclusive jurisdiction of the English court.
Except in respect of a payment obligation, neither you nor Garden Home and Leisure llp will be held liable for any failure to perform any obligation to the other due to causes beyond your or Garden Home and Leisure llp’s respective reasonable control.

None of the above affects your rights as a consumer.

We will not be liable to you or in breach of contract for delay or failure to perform due to a cause beyond our control.

Failure or delay by either party enforcing an obligation or exercising a right under these Terms and Conditions does not constitute a waive of that obligation or right.
Products on this website are for the current time available only to UK residents.

Delivery Method

Forest has been working closely with its chosen transport companies for over five years. Some of our smaller products will be delivered by a nationwide parcel delivery company who has been operating since the early 1980s whose service is second to none. For larger items, we use a trusted third party home delivery provider.

The delivery will be made to a safe location within the property boundary, and where possible this will be off any public footpaths or highways. We ask that your customer ensures there is sufficient space on your property to accept the order. Deliveries are made between 8a.m. and 6p.m., Monday to Friday (excluding bank holidays).

Our delivery team will contact your customer at least 24 hours' notice of your delivery. If they are not available to take delivery, Forest must be informed. Our distributor will not leave the product unless there is someone present to sign for it, unless we have been given prior authorisation to do so.

If a delivery date has been agreed and on this date either no one is present (unless agreed with Forest), or no safe location is available off public footpaths or highways for delivery of the product, the product will be returned to our distribution depot and a calling card left. To have the product re-delivered your customer will need to pay a re-delivery charge of £45 before the product can be released for re-delivery.

If your customer is offered a delivery date that is inconvenient, they can refuse the proposed delivery date. Please be aware that refusing this date may extend the lead-time beyond that published.

Delivery Lead Times

We will aim to deliver your customers order within a 21 working day lead time. As mentioned above, refusal of a given delivery date may extend the lead-time beyond that published.


Receipt of Delivery

Upon delivery of the product the customer must inspect the package and product before signing for the delivery. Please ensure that any damage noted at this point is endorsed clearly on the proof of delivery. If the customer experiences any problems at the point of delivery they can contact us directly on 0870 191 9805 whilst the driver is still with them. At this point we will evaluate the problem and discuss the best course of action.


Delivery Offer:- Postcodes

The following postcodes are excluded from our delivery offer: BT, GY, HS, IM, IV, JE, KA, KW, PA, PH, PO, TR, ZE




Product Availability

All items are subject to availability.  We cannot guarantee availability. If the goods are unavailable we will initially provide a date when they will be back into.  If the product is no longer available we will contact you with suggestions of alternative goods with an equivalent quality and price.

We will endeavour to deliver the goods within the times stated but goods are subject to availability and delay in delivery of goods is sometimes out of our control.

Any dates that we specify are approximate and we will not accept any responsibility for losses, costs, damages, charges or expenses caused by any delay of the delivery of the goods.

The customer should allow enough time for the products to be delivered and inspected before booking tradesmen. We cannot be held responsible for out-of-pocket expenses resulting from products being unavailable or a delay in delivery.


After Delivery

Your customer should take the time to check the product and all its parts in full within 7 days of product receipt. Attached to the product is a list of components.

Any shortages, damage or manufacturing faults should be reported to our home delivery team on 0870 191 9805 within 7 days of product receipt. In most cases customer services will resolve the problem by sending a new part.

Where the product has been partially assembled, we will assume that all parts were present and correct at the time of delivery and no refunds or replacements will normally be available.

Any problems reported after 7 days can be resolved but may be charged at a cost of the product or part and delivery. Costs will be confirmed on request.


On Assembly

All our products will require assembly.

Your customer should follow the assembly instructions. There will be replacements for incorrect installation or assembly.

As we assume that products that have been installed, assembled, painted or modified in any way were not defective at the time of delivery, no replacements will normally be available for such products.

Exercise particular care with roofing felt. If cut incorrectly you can purchase additional roofing felt from most good DIY retailers.

Some buildings are pre-treated with a factory base coat for protection during storage and transit. In this instance, we recommend that your customer treats their new building as soon as possible after assembly using a suitable wood preservative treatment.  Apply in accordance with the manufacturer's instructions.

If your customer experiences any problems whilst assembling your their product they can contact our home delivery team on 0870 191 9805.

If once assembled or partially assembled and your customer reports that the product is faulty, we reserve the right to attend their premises to view the product to determine whether there is a defect for which we are responsible. There is a call out charge of £95 payable in advance for such a visit, which will be fully refunded if we find that there is a defect in the product for which we are responsible.


Cancellations

Your customer may cancel/amend their order with us and receive a full refund up to the day prior to delivery, at no charge. Cancellations must be confirmed in writing by fax, letter or email. If your customers order is cancelled after the goods have been dispatched a charge will be made for carriage of the goods. You are advised to check the status of the order before requesting cancellation.


Returns

It is our normal policy to supply replacement parts or to repair defective products.

In the event that we agree to collect a defective product from your customers premises (which product cannot be assembled or partially assembled), an authorisation letter will be sent, which will include product labels. The labels must be completed and attached to the product. Failure to do so will result in an aborted attempt to collect the product. Where collection is aborted for reasons unconnected with us or our carrier, a collection charge of £35 must be paid before recollection is attempted.

On return of the product, if it has been modified in any way (painted/treated/assembled) then the refund will be refused.
